1. Acceptance of Terms

Welcome to ProxApply. By accessing or using our job application proxy service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and ProxApply ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

ProxApply is a job application proxy service that submits job applications on behalf of registered users. Our Service includes:

  • Submission of job applications to selected employers and job platforms
  • Customization of CVs and cover letters for specific job postings
  • Tracking and management of application status
  • Standard and Premium application tiers with different service levels

Important: ProxApply is a facilitation service. We submit applications on your behalf, but we do not guarantee job interviews, offers, or employment. The hiring decision rests solely with the employer.

3. Eligibility

To use ProxApply, you must:

  • Be at least 18 years of age
  • Be legally eligible to work in the jurisdictions where you are applying for jobs
  • Provide accurate, current, and complete information
  • Have the legal right to share all materials you upload (CV, portfolio, etc.)
  • Not be prohibited from using our Service under applicable laws

4. User Accounts and Responsibilities

4.1 Account Registration

You must create an account to use our Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Accurate Information

You agree to:

  • Provide truthful, accurate, and complete information in your profile and application materials
  • Update your information promptly when it changes
  • Not misrepresent your qualifications, work history, or credentials
  • Not upload false, misleading, or fraudulent documents

4.3 Prohibited Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe upon the intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Use automated means (bots, scrapers) to access the Service without permission
  • Harass, abuse, or harm other users or our staff
  • Submit applications for positions you are not qualified for or interested in

5. Pricing and Payment

5.1 Service Tiers

We offer two service tiers:

  • Standard Applications: Basic application submission with standard turnaround time
  • Premium Applications: Priority processing with enhanced customization and faster turnaround

5.2 Payment Terms

  • Payment is required before application submission
  • All payments are processed securely through Stripe
  • Prices are displayed in GBP (£) and are subject to change
  • Bulk discounts may apply as displayed on our pricing page
  • All fees are non-refundable once an application has been submitted (see Section 6 for refund policy)

5.3 Taxes

You are responsible for any applicable taxes, duties, or fees related to your use of the Service, except for taxes based on our income.

6. Refund and Cancellation Policy

6.1 Pre-Submission Cancellations

You may cancel your order and receive a full refund if:

  • Your application has not yet been submitted to the employer
  • You request cancellation within 24 hours of purchase

6.2 Post-Submission

Once an application has been submitted to an employer, the fee is non-refundable. This is because:

  • The work has been completed and delivered
  • Applications cannot be "recalled" once submitted to external platforms
  • Our experts have invested time and resources into your application

6.3 Service Issues

If we fail to submit your application due to an error on our part, you will receive a full refund or a free resubmission, at your option.

7. Intellectual Property

7.1 Your Content

You retain all rights to the content you provide (CV, cover letters, portfolio materials, etc.). By using our Service, you grant us a limited, non-exclusive license to use, modify, and distribute your content solely for the purpose of submitting job applications on your behalf.

7.2 Our Content

All content on the ProxApply platform, including but not limited to text, graphics, logos, software, and design, is owned by or licensed to ProxApply and is protected by copyright, trademark, and other intellectual property laws.

8. No Guarantee of Employment

Important Disclaimer: ProxApply is an application submission service only. We do not and cannot guarantee:

  • That you will receive job interviews or offers
  • That employers will review or respond to your applications
  • Any specific outcome from the job application process
  • Employment or income as a result of using our Service

Hiring decisions are made solely by employers. We are not responsible for employer actions, hiring practices, or the results of your job search.

9. Limitation of Liability

To the fullest extent permitted by law:

  • ProxApply is provided "as is" and "as available" without warranties of any kind
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability to you for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim
  • We are not responsible for errors in your application materials provided by you
  • We are not responsible for technical issues with employer application systems

10. Indemnification

You agree to indemnify, defend, and hold harmless ProxApply, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • False or misleading information you provide

11. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Third-Party Services

Our Service integrates with third-party services, including:

  • Clerk: Authentication and user management
  • Stripe: Payment processing
  • Job Platforms: Various employer websites and job boards

Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the practices or content of third-party services.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, us, or third parties
  • Violates applicable laws or regulations
  • Involves fraudulent or deceptive practices

You may terminate your account at any time by contacting us. Termination does not relieve you of any obligations incurred prior to termination.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

14.2 Informal Resolution

If you have a dispute with us, please contact us first to attempt to resolve the issue informally.

14.3 Arbitration

Any disputes that cannot be resolved informally will be resolved through binding arbitration in accordance with the rules of the relevant arbitration body.

15. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms periodically. Material changes will be communicated to you via email or through the Service.

Your continued use of the Service after changes to these Terms constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ProxApply regarding the use of the Service and supersede any prior agreements.
